In algerian law , there are several types of institutions ,which differ according to their legal nature and the purpose of their establishment .the main types include :
- public institutions of an administrative nature (EPA) :
- these are state-run instutions with legal personality and financial independence ,but they operate inder state supervision and provide non-commercial public services .
- Example : universities ,public hospitals
- Legal Basis : article 16 of the algerian constitution and law no , 88-01 related to public instutions of an administrative nature.
2 . public industrial and commercail institution(EPIC):
- these instutuion carry out economic activities of a commercial nature .they are state -owned and subject to public oversight .
- EXAMPLE : water and sanitation companies urban transport .
- Legal BASIS: ordinance no,95-20related to state economic institutions .
3 . Private economic institution :
- these are businesses owned by natural or legal persons and are governed by commercial law .
- LEGAL FORMS: limited liability companies (SARL) , joint-stock companies (SPA) , general partneeships,etc .
- LEGAL BASIS : Algerian commercial code , especially Articles 544 to 840.
4 . public economic enterprises (EPE) :
- these are commercail companies wholly pr partially owned by the state and governed by corporate law.
- LEGAL BASIS : ordinance no , 01-04 concerning the organization of public economic entrprises.
5 . charitable and religious intitutions :
- such as endowments (waqf) and religious association , which are nonprofit entities with social or religious objectives .
- LEGAL BASIS : waqf law (law no,91-10) and associations law no , 12-06 .
- these are bodies established by the constitutions and play political , oversight , or judicial roles .
- EXAMPLES : the constitutional court ,the councilof the nation ,the court of auditores .
- LEGAL BASIS: algerian constitution ( particularly articles 170 to 191 ) .
